What Is a Probate Bond — and Why Might You Need One?

If you’re the executor of a loved one’s estate, there’s a good chance the court will require something called a probate bond before you can move forward.

But what exactly is a probate bond?

Think of it as insurance for the estate.
It’s the court’s way of making sure the person managing the estate — the executor or administrator — handles everything honestly, legally, and responsibly.

If something goes wrong (for example, mismanagement of assets or funds), the bond provides a financial safety net that protects the beneficiaries. In short, it helps ensure the estate is handled in good faith.

Do All Executors Need a Probate Bond?

Not always — sometimes the will waives the bond, or the court may decide it’s not necessary. But in many cases, especially if there’s no will or disputes among heirs, the court may require it as an extra layer of protection.
